Strauss-Kahn ex-lover says ready to testify (AFP)

PARIS (AFP) ? A Frenchwoman claiming to be an ex-lover of former IMF chief Dominique Strauss-Kahn said she would testify in the scandal over attempted rape charges against him if asked, in comments published Sunday.

She was photographed and identified as Marie-Victorine M., a 38-year-old consultant, by French newspaper Le Journal du Dimanche, which said she started an affair with Strauss-Kahn in 1997 after her father introduced them.

She also described her affair with Strauss-Kahn in an interview published this weekend in Swiss magazine L'Illustre, in which she said her testimony would most likely benefit Strauss-Kahn's defence.

"I am not here to kick a man who is down," she added in that interview. She replied "yes" when asked if she would testify, but told L'Illustre: "I think that would no doubt benefit his defence more than his accusers."

She said in both interviews that she had been quizzed by the lawyer of Nafissatou Diallo, the hotel maid who accuses the powerful French politician of sexually assaulting and trying to rape her in a Manhattan hotel room.

Diallo spoke out this week about the case after prosecutors shed doubt on her credibility and a judge released Strauss-Kahn from house arrest.

Diallo's lawyer, Kenneth Thompson, warned of a civil suit even if Strauss-Kahn escapes criminal trial.

Another Frenchwoman, the writer Tristane Banon, 32, has brought legal action against Strauss-Kahn alleging that he tried to rape her in Paris in 2003.

Banon is the god-daughter of Strauss-Kahn's ex-wife and the daughter of a fellow member of his opposition Socialist party who herself has admitted having a consensual sexual encounter with him.

Banon too has talked to Diallo's legal team.

Cusack, Cage team up for dark drama "Frozen Ground" (Reuters)

LOS ANGELES (TheWrap.com) ? John Cusack, who played a killer in 1997's "Grosse Pointe Blank," is getting back to his murderous ways.

And Nicolas Cage -- a police officer in the 2006 "Wicker Man" -- is going after him.

The two will play a killer and the cop who arrests him in "Frozen Ground," TheWrap has confirmed.

It's dark stuff, about the serial killer Robert Hansen, who murdered between 17 and 21 women near Anchorage. His crimes were especially grotesque: He abducted and raped women, flew them to a desolate area of Alaska, released them on sandbars and then hunted and killed them.

He was arrested after a 17-year-old victim got away and went to police while Hansen was loading supplies onto his airplane.

In the movie, Cage's character finds the girl alive on the street.

Hansen ultimately was charged with four murders. He pleaded guilty and was sentenced to 461 years in prison.

Scott Walker is directing the movie, which he also wrote.

I am a teacher. ?I am a student. ?I am a daughter and a sister, a partner and a friend. ?I come from a family of teachers (music, math, special education, art), librarians, social workers, and journalists. ?And tomorrow, I will hold all these things in my heart as I march past the White House to tell President Obama that what he is doing has stolen my country.

President Obama does not know me. ?He has no reason to listen to me except that I am a human, that I think and feel and sweat and bleed like the rest of my species. ?That should be enough. ?I hope it will be.

So far, it has not been enough. ?On February 11, 2011, I wrote Governor Walker a long letter. ?I concluded it like this:

Although I am not a native, I have lived and worked here longer than anywhere else. ?I have grown to love this place and its character, and to value the education?both formal and emotional?it has given me. ?I would like nothing better than to continue my life here, to watch my students as sparks of curiosity, dedication, and hard work become the flames that light the way for the next generation.

I can imagine nothing more tragic than watching over the next few weeks as you, Governor?Walker, lean over and blow those sparks out.

He did not respond.

For weeks, I stood freezing outside the Capitol and sweltering in Capitol hallways, alongside my brothers and sisters from around the state, asking only for my voice to be acknowledged. ?Asking the democratically elected leader of my state to do something he was elected to do: serve the people of Wisconsin.

He did not meet once with those who opposed passage of the Budget Repair Bill.

So I gave up on him and moved on: to the President who was supposedly pro-teacher, pro-education, and who really ought to put his proverbial money where his mouth has been for some time now. ?I understand that right now he?s being distracted by the Republicans? collective temper tantrum. ?He?s being distracted by an economy in crisis, by greedy corporations, and by pressure from all sides.

That is no excuse. ?Teachers, too are distracted. ?We work long and hard, spending hours past those we are compensated for doing our jobs. ?Later, we do other jobs, like organizing protests. ?Sometimes, we even talk to our family members, when we?re not frantically writing emails over dinner.

Despite our obligations and for the most part at our own expense, we are coming together here in DC to say: we have said our piece. ?We have said it loudly and clearly, in print and on TV and on the radio. ?We have advocated for our students and for each other, and we have been systematically and sometimes forcibly silenced. ?Arne Duncan and other of his ilk have coopted our words and attempted to portray us as a fringe element.

We are not a fringe. ?We are the futures of your children. ?We are the futures of this country. ?We will not be silenced.

Tomorrow, holding a Wisconsin flag, I will be marching. ?I will be shouting with the voice I have been guaranteed by my country?s most venerable document. ?I will not be silenced.

Elder care, being the caregiver for an elderly relative, can harm your career. This is the conclusion of the 1999 MetLife Juggling Act Study conducted by The National Center for Women and Aging at Brandeis University and The National Alliance for Caregiving. According to this study on the effects of elder care on working Americans, caregivers give up promotions, raises, and training opportunities. They take a leave from their jobs, cut their hours, or quit their jobs altogether.

Who Feels the Effect of Elder Care?

More women than men are the primary caregivers for their older relatives. The Family Caregiver Alliance reports that "the average caregiver is age 46, female, married and working outside the home earning an annual income of $35,000." ("Women and Caregiving: Facts and Figures")

Balancing Elder Care and Your Career

While it is difficult to miss out on a promising career opportunity, it is more difficult for most people to disregard the needs of an elderly relative. For babyboomers, who were among the last to experience the phenomenon of the "Leave It to Beaver" stay-at-home mom, it would be unthinkable to turn one's back on a parent in need. Now comes the issue of balance ? how do you balance mom's and dad's needs with your career aspirations? Not to mention the fact that many of these caregivers are also working parents, dealing with child care issues as well.

If you are dealing with a short-term crisis, you should consider taking advantage of the Family and Medical Leave Act. The Family and Medical Leave Act (FMLA) allows you to take up to twelve weeks of paid and unpaid leave to care for a sick relative.

If you will be caring for an elderly relative at home for a period longer than three months, you will have to find another way to balance career and elder care. In lieu of leaving one's career behind, which for many reasons may not be an option, there are other choices.

Exclusive: SEC builds new tips machine to catch the next Madoff (Reuters)

WASHINGTON/NEW YORK (Reuters) ? For more than three years, U.S. securities regulators investigated allegations of accounting fraud at a small telecom firm called China Voice Holding Corp, but could not make a case.

Then last November, they got an unexpected break. A Texas-based tax consultant doing work for a firm affiliated with China Voice contacted the U.S. Securities and Exchange Commission with information about suspicious money transfers she'd detected.

The call from Dee Dee Stone was quickly routed to a preliminary version of the SEC's new $21 million "Tips, Complaints and Referrals" or TCR Database, which the agency later fully deployed in March. Within 24 hours, Stone, a former Internal Revenue Service agent, got a call from an SEC attorney spearheading the China Voice inquiry.

Five months later, the SEC on April 29 sued several China Voice executives, claiming they had duped investors out of $8.6 million in a Ponzi scheme. Agency lawyers say without Stone's help, regulators may not have even discovered the scheme, let alone made a case so soon.

The alleged fraud at China Voice was small in the annals of Wall Street sins. But the SEC's response to Stone is an indication that after dropping the ball on Bernie Madoff, the nation's top securities cops are trying to modernize the way they handle tips and complaints about potential wrongdoing.

The TCR Database is the SEC's most significant response to its well-documented fumbling of early tips about Madoff's $65 billion fraud. The SEC's new Office of Market Intelligence, which last summer also forged a first-of-its kind partnership with the Federal Bureau of Investigation, is using the database as a key tool.

The changes are part of an effort by SEC Chairman Mary Schapiro to overcome the agency's reputation for being a step or two behind the bad guys. It is far too soon for the SEC to declare victory. But some of the agency's harshest critics notice a change.

Among them is Harry Markopolos, the Boston-based financial analyst and fraud investigator best-known for trying to alert regulators about problems with Madoff's operation. Markopolos said since the database went into operation, he has submitted three of his own tips. In all three cases, he heard back from an SEC attorney within days, or in one case, a few hours.

"Everything they should have done in the Madoff case they are now doing," said Markopolos. "They have done a fantastic job of reforming themselves."

In February 2009, Markopolos told the House Committee on Financial Services that the SEC's "investigative ineptitude and financial illiteracy" permitted Madoff's crimes to go on for so long.

PAPER, PENCILS & FAXES

It took the embarrassment of the Madoff scandal to drag the SEC into the 21st century when it comes to tracking tips and complaints.

Tips used to come via phone calls, e-mails, faxes and even handwritten letters into the SEC's 11 regional offices and Washington headquarters. Before the Madoff case, the SEC's Los Angeles office might receive a written complaint about a bad broker, for instance, and stuff the letter into a filing cabinet if it was deemed without merit. So, if later on a complaint about the same broker was sent to the SEC's Chicago office, staff there would have no easy way of knowing about the earlier tip and connecting the dots.

Sometimes, the only way an attorney could find out if someone had looked into a complaint would be to call all the other SEC offices.

"It was a sieve, basically," says Russ Ryan, a partner in the Washington law office of King & Spalding who spent a decade at the SEC before leaving in 2004. "It probably got better as I went along in my career, but I remember back when I first started there, it was a lot of paper and pencil type stuff."

Now with the TCR Database, once a tip or complaint is entered into the system, about 2,300 SEC employees can see it and add new information.

"All of the plumbing was brought into one place," said Thomas Sporkin, a nearly 19-year veteran SEC attorney in Washington, who oversees the agency's new Market Intelligence Unit and its 41-member team.

The database is emerging alongside a new program by the FBI's criminal profiling group in Quantico, Va. that is creating a series of behavioral composites to help agents investigate white collar crime.

The more systematic approach by the SEC and FBI comes in response to the growth and complexity of financial crimes in recent years. In the US government's 2010 fiscal year, the FBI's economics crime unit reports the bureau had 1,703 active securities and commodities fraud investigations, a 41 percent increase over the number of active investigations in 2008.

Over the past year, the amount of monetary penalties the SEC has imposed on wrongdoers has almost tripled, with high-profile cases against companies such as Goldman Sachs, Citigroup and Morgan Keegan for their roles in the crisis.

Sporkin's 41-member Market Intelligence Unit last month moved into new offices in Washington that look a little bit like a Wall Street trading floor, where they process more than 100 tips, complaints and referrals that come in each day.

The group's chief task is to ensure legitimate tips, like the one from Stone about China Voice, get routed to the right attorneys. The triage process begins with analyzing the information provided by tipsters, whistleblowers and self-regulatory organizations on an online questionnaire in the TCR Database portal.(https://denebleo.sec.gov/TCRExternal/index.xhtml)

The SEC is also trying to revamp the way it uses the raw data it gathers. Sporkin's team is working side-by-side with an FBI expert in financial crimes under a deal agreed to last August.

The FBI agent gets to look at all the tips about securities fraud as they come into Sporkin's team. For the FBI, the partnership offers the promise of faster criminal investigations. For the SEC, it's a chance to learn a trick or two from law enforcement.

Having an FBI agent embedded with the SEC "is really revolutionary," Sporkin said.

Other regulators are trying to set up their own FBI partnerships, including the Commodity Futures Trading Commission, which regulates the futures and over-the-counter derivatives market. The CFTC, which declined to comment, has also been closely studying the operation of Sporkin's team.

THE FBI EMBED

Jeffrey Horner, the FBI agent embedded with Sporkin's group, is an accountant who worked for audit giant PriceWaterhouseCoopers before joining the bureau in 2004.

Horner says he's not allowed to talk about specifics, but the nearly year-long partnership has led to new leads and bolstered existing FBI files.

"Some of the raw data that comes into the SEC, the (FBI) case agents may not be aware of," he said. "So plugging them in with the SEC and the information that the SEC has can be very valuable to an ongoing investigation."

FBI agent Horner is also sitting in on two SEC working groups examining micro-cap fraud and Chinese businesses that have done so-called reverse mergers with small U.S. shell companies. The FBI has opened its own broad investigation into reverse mergers and allegations of accounting irregularities.

Horner also uses the SEC's tips system to drill into areas of particular interest to the FBI. Right now, for instance, he is on the lookout for tips about high-yield investment scams as well as high-priority areas such as insider-trading and market manipulation.

The real test of the partnership -- and the effectiveness of the TCR Database -- will lie in the kind of cases the SEC and federal prosecutors file.

An independent analysis of the work of Sporkin's team could come when SEC Inspector General David Kotz conducts a planned audit of the Market Intelligence Unit's triage work. Kotz, who issued a scathing report on the SEC's failures in the Madoff affair, has called the new database an adequate response to ensure tips are "acted upon in a timely and appropriate manner."

Former SEC lawyers and securities attorneys wonder whether more agents need to be assigned to the SEC-FBI partnership.

"My sense is that there would be so many things going across that person's desk, I am not sure one person can manage it," said James Cox, a law professor at the Duke University School of Law.

Officials with the SEC and the FBI don't rule out an enhanced relationship. They note that before Horner was embedded with the SEC, the two agencies coordinated on major investigations, such as the probe into insider trading by hedge funds.

At the same time, officials say they are sensitive to law enforcement protocols prohibiting prosecutors and the FBI from sharing investigative materials, such as wiretapped conversations, with securities regulators. They say it's easier for the FBI and SEC to work hand-in-hand before an investigation gets going to avoid any defense allegations of improper collaboration or information-sharing.

REWARDING WHISTLEBLOWERS

Sporkin's group is a work in progress and the TCR Database has some limits. It can't yet be cross-checked against other internal databases. The system s not advanced enough to perform more sophisticated analysis or data-mining, such as cross-checks against trading activity, company filings or news feeds.

"It will be several years before we really see whether this new system is a success," said Bradley J. Bondi, a former SEC attorney who is now a partner with Cadwalader, Wickersham & Taft LLP. "But I think the new system is a step in the right direction."

It's a system Sporkin expects will become bigger and better over time, especially now that the SEC in May finalized rules for its own whistleblower program, rewarding individuals who provide the agency with a high-quality tip that leads to a successful enforcement action.

Stone's tip about the potential Ponzi scheme at China Voice came in November 2010, after she says she grew concerned about the number of complaints she was hearing from investors in China Voice and related partnerships.

On May 31, Stone, testifying before a U.S. judge in Dallas in the China Voice case, said she learned about the new whistleblower rule only after hiring an attorney in advance of her court appearance. Her attorney, Misty Gutierrez, declined to comment; Stone didn't return telephone calls to her consulting business, Number Crunchers.

Stone told U.S. District Judge Reed O'Connor she started reviewing the bank statements for China Voice and those related companies after hearing the complaints, and quickly concluded, "something was wrong."

She talked about the money transfers with a friend who also once worked for the IRS and agreed the math didn't add up. The next day, Stone said she called the SEC.

East Coast sees slight relief from dangerous heat wave (Reuters)

WASHINGTON (Reuters) ? The powerful heat and humidity that plagued the eastern half of the United States for days started to fade on Sunday, to the relief of many sweltering residents, forecasters said.

Temperatures in Washington, New York and elsewhere along the East Coast hovered in the 90s, down from the triple-digits on Friday and Saturday.

Records were set on Friday in Newark, N.J. at 108 degrees and in Dulles, Va. at 105 degrees.

At its peak, the heat wave put some 132 million people under a heat alert and was blamed for as many as 34 deaths, according to the National Weather Service.

"The huge area of high pressure at most levels of the atmosphere responsible for the dangerous, record-setting heat in multiple states is backing out of the northeastern U.S. and neighboring Canada," AccuWeather.com's senior meteorologist Alex Sosnowski said.

A heat alert remained in effect until evening as well as a Code Orange air quality alert, meaning that air pollution concentrations may be unhealthy for children, elderly people or people in poor health.

Slightly cooler air from Canada was starting to drift across the Midwest and the Northeast, bringing showers and thunderstorms.

A record 6.86 inches of rain fell in Chicago on Saturday, forcing the cancellation of flights and the closing of parts of some highways and train lines.

No relief was in sight, however, for the southern plains where triple-digit heat will continue to roast states such as Kansas, Oklahoma, Texas and Arkansas, forecasters said.

The heat has exacerbated droughts in Texas and Arkansas.

India cuts growth forecast as rate hikes bite (AFP)

NEW DELHI (AFP) ? India on Wednesday cut its growth forecast for this financial year to 8.6 percent from nine percent, its economy hit by a string of interest rate hikes to tame inflation which is nearing double-digits.

The finance ministry's forecast for Asia's third-largest economy is above last year's expansion of 8.5 percent and exceeds most private economists' expectations, which are as low as 7.5 percent.

There has been a "perceptible slowdown" in the past two financial quarters, the ministry noted, according to the Press Trust of India news agency.

The Congress-led government had projected nine percent growth for this financial year to March 2012 in its budget presented in February but 10 interest rate hikes since March 2010 have hit industrial output.

The ministry said that hiking rates can dampen growth in the short term but such steps are positive for sustained longer-term growth.

The government's decision to lower its growth projection came after data earlier in the month showed industrial output in May grew just 5.6 percent year-on-year -- its weakest pace in nine months.

India's economy grew by just 7.8 percent in the January-March quarter, the lowest in five quarters.

While growth of seven-to-eight percent would be envied by Western economies, experts say India needs at least 10 percent expansion to lift hundreds of millions of Indians out of crushing poverty.

Neighbouring China, which is also tightening monetary policy to fight inflation, reported this month that its economy expanded at a slower but still robust 9.5 percent year-on-year in the second quarter.

"Everybody has been accustomed to India growing at around eight percent for the last 10 years and I don?t think it will (in future)," analyst Mark Matthews of investment house Julius Baer told CNN-IBN network.

"Over the next year or so, I think that (growth) will come down to below seven percent," he said.

The finance ministry said the central bank was aiming "to moderate demand" to ensure that the economy does not overheat and fuel inflation.

The ministry also warned that high commodity prices and the eurozone sovereign debt crisis could hit India's strong export expansion, which has been bolstering growth, and forecast a slowdown in global trade volumes.

During the first quarter of the financial year, from April to June, India's exports surged 46 percent, buoyed by renewed demand in European and US markets.

Analysts expect the central bank to hike interest rates again at a scheduled meeting later this month as it struggles to subdue inflation running at 9.44 percent.

High prices have caused huge hardship for the country's poor, who are key supporters of the government, which is reeling from a string of corruption scandals.

Final "Harry Potter" wields big wand at box office (Reuters)

LOS ANGELES (Reuters) ? Harry Potter's final film adventure has bolted to a big start at worldwide box offices, breaking the record for midnight screenings in the U.S. and Canada with $43.5 million and setting the stage for a massive weekend debut.

Internationally, "Harry Potter and the Deathly Hallows -- Part 2" has sold $82.5 million in tickets since Wednesday, when it opened in dozens of countries, distributor Warner Bros. said on Friday.

Combined, Thursday's midnight screenings in domestic theaters and the two-day total overseas gives "Deathly Hallows -- Part 2" a total of $126 million globally so far. The film begins is wide release in the U.S. and Canada on Friday.

Box office watchers predict domestic (U.S. and Canada) sales for the three-day weekend will hit $125 million to $150 million, but with the midnight record that range could be low. Even if the box office total hits that forecast, it would be the highest-grossing "Harry Potter" debut and put the movie within striking distance of the biggest opening weekend ever.

The record belongs to 2008 Batman movie, "The Dark Knight," which collected $158.4 million in its initial three-days.

"Deathly Hallows -- Part 2" is the eighth and final movie in the "Harry Potter" franchise and the first in 3D. It also is showing on large format IMAX screens, and sold a record $2 million for a midnight IMAX opening, according to Warner Bros., a division of Time Warner Inc.

The earlier films have generated more than $6.4 billion in ticket sales since the first movie a decade ago, plus billions more from DVDs and merchandise. The movies are based on novels by British author J.K. Rowling.

Loyal fans eager to say farewell are expected to drive big numbers for the conclusion of the battle between good and evil in a fantasy world of witchcraft. Moviegoers, some sporting "Potter"-inspired costumes, lined up at theaters for the first showings and events coordinated with the film's debut.

Many early screenings were sold out before the movie opened.

Should i stop contributing to my 401k if??..? | Roth Ira

I am hearing that some companies are suspending their matching contributions to employees 401k contibutions for 1 year to help the companies bottom line.

Here is my question. My company currently matches up to 6% of what i contribute to my 401k. If my company stops that match for 1 year, would it be wise for me to stop contributing to my 401k for that 1 year, and put that contribution into my Roth IRA?

The reason i ask is because from what i understand, you definately want to contribute up to the point of what your company will match in your 401k. Then if you have more money you can invest, it should be contributed to a Roth IRA. Then once you have maxed out the amount you can put into that Roth IRA, and if you still have more to contribute, then you should go back to the 401k and resume contributing to it.

Mexico soldiers find 'largest' pot plantation ever (AFP)

TIJUANA, Mexico (AFP) ? A Mexican military commander said Thursday that his soldiers discovered a record-busting marijuana plantation 120 hectares (nearly 300 acres) large in the state of Baja California.

"It is the largest marijuana plantation in Mexican history," General Alfonso Duarte, the commander of the military region based in the far north-western border city of Tijuana, told AFP.

Duarte said the plantation can produce 120 tons of marijuana, which he valued at nearly $160 million.

The plantation, which includes housing for some 60 workers, is hidden in an area best known for raising tomatoes, he said.

The Baja California plantation is nearly twice as large as the previous record marijuana plantation, a 64 hectare pot farm in the northwestern state of Sinaloa discovered in 2007, the military said in a statement.

Soldiers found the plantation while on ground patrol, and arrested six of the nearly 20 people who were working at the time, Duarte said.

Duarte added that he did not know which drug cartel owned the plantation.

The plantation is located near the center of the Baja California peninsula, the general said, but refused to be more specific about the location.

Separately, the Catholic bishop of Saltillo, in the northern border state of Coahuila, said that drug cartels are recruiting children and paying them to act as watch guards.

The kids, usually boys around the age of 12, are paid $120 a week, Bishop Raul Vera told the daily La Jornada.

From the looks of Katie Holmes on the cover of the August InStyle (on sale July 15), we can't imagine her ever worrying about needing plastic surgery. But the 32-year-old admits that she has been thinking about getting older, and says she hoping to "age gracefully."

Still, Tom Cruise's wife isn't ruling out anything. Holmes admits if she finds that the age gods are not being so forgiving, she may just "have to figure it out."

"But I don’t think I’m ever going to do my lips — my sisters would kill me!" Holmes laughed, of her three older sisters, who she played dress-up with when she was younger.

For now, Holmes -- who has her own high-end fashion line at Barneys New York -- is using her killer fashion sense to keep herself looking good. "I'm not afraid to try a new designer or do something trendy, but it has to look right on my body," she says. "You don’t want to look like a fashion victim!"

And, though you made find this hard to believe, not everything is a hit on her.

"Certain colors don’t work on me; yellow isn’t my friend," Holmes admits. "I don't like big, pouffy sleeves. And some dresses, like if it has a big bow and skirt, are too old-ladyish on me. If I can wear it when I'm 80 I’m going to wait." 

Still, there's one go-to article of clothing that can always make her feel good. Holmes reveals her favorite fashion splurge is nice underwear!

“They make you feel special when you put them on in the morning,” she explains. “Even when I was a little girl I loved my ‘days of the week’ pairs. I love the hot pink ones, that makes my day!"
